Seller\/Provider <\/b>– Monastery Living SRL<\/p>

Buyer<\/b> – the natural\/legal person who places an order<\/p>

User\/Visitor <\/b>– all natural\/legal persons who access the monastery.living website, regardless of the reason<\/p>

Member\/Client<\/b> – all natural\/legal persons who have registered based on the e-mail address and the data provided at registration: Name, Surname, identification data, etc.<\/p>

Agreement, Contract, Terms and Conditions<\/b> – are used to designate this agreement for the use of the products and services offered by the Company.<\/p>

Account – <\/b>the section of the site consisting of the email address and password that allows the user to place the order and holds information related to the user and the history of orders, warranties, returns, etc.<\/p>

Products and services <\/b>– refer to the goods and services placed in the order by the user to be provided by the seller to the buyer as a result of the concluded contract.<\/p>

Transaction – <\/b>the collection or reimbursement of an amount of money resulting from the sale of a product\/service by Monastery Living SRL to the buyer, by using payment methods, regardless of the delivery method.<\/p>

Newsletter – <\/b>information campaign at certain time intervals, carried out exclusively online, on the products\/services provided by www.monastery.living and on the promotions carried out<\/p>

www.monastery.living<\/a> provides visitors and its members with access to a rich collection of online resources and tools, including products and services for personal use. We strive to update the site’s content periodically and provide complete, accurate information for our users. Monastery Living SRL will not be held responsible for any errors or omissions. We reserve the right to modify, terminate or suspend the provision of a service or any other content of the Site without prior notice. Errors or omissions can be reported at info@monastery.living. All information used to describe the products available on this site does not represent a contractual obligation on the part of the seller and is used for presentation purposes. <\/p>

Any use of the website that is not in accordance with its original purpose, and any violation of these Terms and Conditions, may result in the application of sanctions provided by law. You understand and agree that the provider’s services include various announcements and administrative messages contained in newsletters, and that these messages are implicit in the online store’s membership. There is an option to opt out of such messages. Monastery Living SRL reserves the right to select its clients. The products sold through the site are new, in the manufacturer’s original packaging, and, at the time of delivery, accompanied by the tax invoice and delivery notice in accordance with the legislation in force. <\/b><\/b><\/p>

The products and services are offered subject to compliance with the provisions of this document and within the limits of available stock. For this reason, the provider assumes the right not to fulfil a certain order if the product is no longer in the current offer or in the supplier’s stock. <\/p>

Prices are updated periodically. The prices shown do not include VAT (19%) or delivery costs, unless expressly specified on the website. The price is expressed in lei (RON). The purchase price printed on the invoice will be the same as the price set by the seller at the time the order is confirmed as a firm order. <\/p>

Despite our efforts, some products may appear on the site with incorrect prices set by our computer application. Under these conditions, the final price is always the price accepted by the customer during phone or email discussions. <\/p>

Discounted sales are part of the category of commercial practices. They are regulated in Chapter V – Commercial practices of OG 99\/2000 on the marketing of market products and services with subsequent amendments and completions. <\/p>

Normally, selling at a loss, below the purchase cost, is prohibited according to Article 17, except for the situations provided for in Article 16, letters a)-c), e)-i), as well as in the case of products in service packages.<\/p>

By “selling at a loss,” we mean any sale at a price equal to or less than the acquisition cost, as defined by the applicable legal regulations.<\/p>

Thus, according to art. 16 of OG 99\/2000 on the marketing of market products and services with subsequent amendments and completions, letters a) \u2013 c):<\/p>

a) The liquidation sales that can be made at a price equal to or lower than the purchase cost are subject to notification to the City Hall based on a detailed inventory of the goods to be liquidated, drawn up by the trader; the origin of the products to be liquidated must be justified with legal documents. It is used only when the company is liquidated, when it changes its object of activity, when there is an interruption or suspension of activity, when natural disasters cause serious damage, or when the stock of goods, in whole or in part, is affected. <\/p>

b) promotional sales, art. 32, can take place at any time of the year, refers to available or replenishable products.<\/p>

The products subject to promotional sale must be on sale for the entire advertised period, or the trader will inform consumers that the offer is valid only within the limit of available stock, and those products are not sold at a loss, so the reduced sale price cannot be equal to or lower than the purchase cost.<\/p>

c) Sales of products that have not been sold within a period of 3 months after supply can be made at a price equal to or lower than the purchase cost, and apply only to goods that must have been purchased 3 months before the discount is applied.<\/p>

Therefore, any sales at a reduced price must be made in strict accordance with the provisions of OG 99\/2000, as such sales are subject to ANPC control.<\/p>

The provider makes no warranties, express or implied, about, but not limited to: the operation of this website, the information, the correctness of the descriptions, the updating of the content, the products on the website, as well as their suitability for a particular purpose. Users expressly agree that the use of this website and the purchase of related products or services are at their own risk, with the exception of the provider’s obligation to grant users the right to unilaterally terminate the contract in accordance with the legislation in force, a right detailed below in this document. SECTION 6 - PRODUCTS, PAYMENT AND DELIVERY\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

Payment for products<\/b><\/b><\/p>

Payment for products ordered on www.monastery.living can be made in cash on delivery, upon delivery by the courier, in advance by bank transfer\/payment order (based on the invoice issued by the seller), or by bank card. Proof of payment is sent to info@monastery.living. <\/p>

In the case of prepayment or bank transfer, delivery will be made only after the funds have been credited to the account. The ordered products must be paid for in full; otherwise, the delivery will not be made. <\/p>

The provider reserves the right to request advance payment for products ordered online in certain cases.<\/p>

Product Delivery<\/span><\/p>

Delivery is FREE, regardless of weight, for orders with a total value over 1,000 lei (VAT included). For orders under 1,000 lei, the delivery cost will be communicated after each order is confirmed. If the customer wishes the products originally contained in the same order to be shipped separately, a fixed shipping cost applies for each additional shipment. <\/p>

The rules for the transport cost above apply to localities directly covered by courier companies. In rare situations where the courier company does not directly cover the destination locality, additional fees will be charged based on the number of additional kilometres to be travelled to you. Of course, we will notify you of this fact before the products are shipped. <\/p>

At the moment, the products on www.monastery.living are delivered only within Romania.<\/p>

For all products, the average delivery time is 2-4 weeks from order receipt.<\/p>

We note that both the delivery time and the delivery cost will be communicated by the provider at the time of order validation. The delivery time may be longer for products that are not in stock. <\/p>

For large pieces of furniture, the products will be delivered to the front of the building where the customer has their domicile or headquarters.<\/p>

Upon receipt of the products, please check the package in the presence of the courier company’s representative before signing or paying for it. If you report damage to the packaging, it is important to contact us by phone. The customer’s acceptance of the products indicates that they have arrived in good condition. The invoice constitutes the sale and purchase contract under Romanian legislation in force. The customer explicitly agrees, by signing the invoice, that he has received the product(s) in accordance with the order and his needs. <\/p>

The Provider reserves the right to delay or cancel deliveries of the ordered products if they cannot be honoured for reasons beyond the Provider’s control, which include: fires, explosions, floods, epidemics, strikes, government actions, wars, acts of terrorism, protests, riots, civil disturbances or other impediments of force majeure according to the customs of Romanian law.<\/p>

The maximum amount of damages that the provider can pay to any customer for non-delivery or improper delivery is the amount the provider collected from that customer.<\/p>

Product warranty<\/u><\/p>

Monastery Living SRL is committed to providing its customers with high-quality products manufactured in compliance with the highest safety standards, in accordance with European and Romanian legislation. The seller ensures and guarantees the conformity of the purchased goods and the absence of any hidden defects. Monastery Living SRL undertakes to deliver the product as described on the website. <\/p>

The seller is liable if the product’s lack of conformity occurred within 24 months of delivery and the customer informs the seller of it within 15 days of discovery. Warranties are resolved by repairing defects or replacing the product. The Seller shall complete the complaints procedure, including, if possible, removing the defect, within 30 calendar days from the date on which the Buyer brought to the Seller’s attention the product’s lack of conformity and handed the product to the Seller pursuant to a delivery-take-back document. <\/p>

If a product is found to be non-conforming upon delivery, the Customer has the right to request repair or replacement within a reasonable period. If these operations are not possible, the Client has the right to request an appropriate price reduction or termination of the contract, in accordance with Law no. 449\/2003, as supplemented by GEO no. 174\/2008. <\/p>

Monastery Living SRL assumes no responsibility for any consequences arising from the improper use or maintenance of the products due to non-compliance with the manufacturer’s instructions. For furniture, to benefit from the warranty, the buyer must comply with the instructions for use. <\/p>

It is not considered to be a lack of conformity if, at the time of conclusion of the invoice, the Client knew or could reasonably not have known about this lack of conformity. The customer agrees that manufactured products and those made of natural materials, such as leather, solid wood, and veneer, cannot be manufactured identically in terms of texture, finishes, colour shades across different surfaces, and the material’s inherent peculiarities. The customer agrees that solid wood products may have small cracks or knots, depending on the nature of the wood, or that small cracks may appear over time, depending on the conditions in which the products are stored. These are not considered quality defects and will not be used to invoke the warranty. <\/p>

The warranty refers to the product’s quality; it cannot be extended to problems\/defects arising from incorrect handling\/use. The warranty conditions are in accordance with Law 449\/2003 (amended by G.E.O. no. 174\/2008) and G.O. 21\/1992. <\/p>

In case of a warranty claim, the customer will send a request to the info@monastery.living e-mail address with the following information: buyer’s details and contact information, a description of the problem found, including photos of the claimed defect, and, if possible, the causes.<\/p>

To remedy the defects that occurred during the warranty period, present the product with its accessories and a copy of the tax invoice. If the products arrive without these documents, the products can be returned to the applicant without paying the warranty. The buyer is responsible for packing the items for shipment to ensure there is no risk of damage in transit. <\/p>

If the deficiencies are not attributable to the Customer, the seller assumes responsibility for repairing or replacing the product at its own expense.<\/p>

After delivery, the Customer can no longer invoke quantitative deficiencies or deficiencies that he could not reasonably have missed at the time of delivery (chips, scratches, pulled wires, bent components, dirt stains, etc.).<\/p>

The warranty is lost in the following situations:<\/p>
